ณัฏฐิกา วรธันยวิชญ์ เกิดเมื่อวันที่ 11 พฤษภาคม 2516 ปัจจุบันอายุ 50 ปี ได้ร่วมตัวสู้กับกระบวนการคนเสื้อแดงทั้งร่วมชุมนุมและภาคออนไลน์ โดยเป็นแอดมินและผู้ก่อตั้งเพจการเมืองหลายเพจตั้งแต่ปี 2552 เช่น Red Intelligence และเรารักพลเอก ประยุทธ์ และเข้าร่วมชุมนุมต่อต้านการรัฐประหารเรื่อยมา จนกระทั่งถูกจับกุมในปี 2559 พร้อมเพื่อนอีก 7 คน เป็นที่รู้จักกันในนามคดีที่ชื่อว่า “8 แอดมิน” ปัจจุบันหลังจากยื่นสถานะผู้ลี้ภัยในสหรัฐฯ ได้ร่วมกับกลุ่มคนไทยเพื่อส่งเสริมประชาธิปไตยและตั้งองค์กร Thai Rights Now และร่วมกับกลุ่ม Milk Tea Alliance ในเมืองต่าง ๆ ในสหรัฐฯ และจัดการชุมนุมเรียกร้องประชาธิปไตยร่วมกัน 

เธอโดนจับกุมในมาตรา 112 จากกล่องข้อความส่วนตัวในโซเชี่ยลมีเดียเกี่ยวกับการวิจารณ์สถาบันกษัตริย์โดยถูกทหารใช้มาตรา 44 บุกจับกุมในบ้านพักโดยไม่มีหมายจับหรือข้อหา แล้วบังคับให้บอกพาสเวิร์ดเข้า Facebook ในค่ายทหาร แล้วถูกดําเนินคดีมาตรา 116 จากการเป็นแอดมินเพจ “เรารักพล เอกประยุทธ์” รวมถึงดําเนินคดีมาตรา 112 ด้วย ถูกฝากขังในเรือนจําหญิง 71 วันก่อนจะได้รับการประกันตัวออกมา คดีถูกส่งฟ้องในศาลทหารในขณะนั้น หนึ่งปี หลังการประกันตัวตัดสินใจเดินทางไปสหรัฐอเมริกา เพื่อยื่นสถานะผู้ลี้ภัยทางการเมือง สุดท้าย มาตรา 112 ยกฟ้องไปเมื่อเดือนมีนาคม 2565 ส่วนมาตรา 116 หากตัดสินโทษว่ามีความผิด ระวางโทษ 7 ปี 

ความเห็นต่อมาตรา 112: ควรยกเลิกทั้งหมด เนื่องจากเป็นกฎหมายที่ละเมิดต่อสิทธิมนุษยชนอย่างรุนแรง รวมถึงถูกใช้เพื่อการกลั่นแกล้งทางการเมืองของฝ่ายสนับสนุนเจ้าและเผด็จการ และการระวางโทษรุนแรงเกินไปเทียบเท่าการก่ออาชญากรรม 

ข้อเรียกร้องจากสังคมไทยและประชาคมโลก: สังคมไทยควรยอมรับว่ากฎหมายมาตรานี้ละเมิดสิทธิมนุษยชนอย่างรุนแรง และการวิจารณ์ระบอบกษัตริย์ควรถูกทําได้อย่างเสรี ตราบใดที่สถาบันกษัตริย์ยังใช้ภาษีประชาชน และแอ้กแองการเมืองไทยอย่างเปิดเผย ประชาคมโลกควรร่วมกันกดดันและให้ความรู้ความเข้าใจถึงกฎหมายมาตรานี้ รวมถึงการกระจายเหตุการณ์การละเมิดต่างๆ ที่เกิดในประเทศไทยให้ประชาคมโลกรับรู้

Nuttigar Woratunyawit was born on 11 May 1973. Currently she is 50 years old. She has long been active in the Thai political scene both participating in protests and serving as an editor of several political pages on Facebook, including "Red Intelligence" and "We Love Gen. Prayuth." She also protested against the 2014 coup. Eventually she was arrested together with her 7 friends, now known as the 8-admin Case. She decided to run away to the United States and sought asylum. In the US, she joined several political movements and organisations. One of these is Thai Rights Now. She is also active in working closely with the Milke Tea Alliance networks in the US. 

Nuttigar has been charged with lèse-majesté because of her criticisms against the monarchy on her private chat platform. The junta exploited Article 44 (Emergency Decree) to arrest her with a warrant. She was locked up in female prison for 71 days before being granted bail. After the release, she traveled to the United States for a refugee status. At present, her 112 charge was dismissed. But she is still charged under Article 116 and could be imprisoned up to 7 years. She is now granted a refugee status in the United States. Nuttigar views that Article 112 and related laws affecting human rights must be eliminated. These laws have been used as a political instrument to protect dictatorship and the punishment is too severe.

 She calls on the Thai society to come to terms with the severity of these laws. Criticising the monarchy is legitimate and can be done in a free society. The royal institution lives on taxpayers' money and it continues to interfere in Thai politics. Meanwhile, international community could play a role in putting pressure on the Thai government. It can bring attention to the world regarding these barbaric laws and how they obstruct expression of free speech.

112Watch 27 สิงหาคม  · Officially launched online now an exhibition "Faces of Victims of 112" showcasing 25 victims and their human stories. This is a part of the exhibition at LeRoy Neiman Gallery at Columbia Univ from 18-25 Sept. We will have a mobile exhibition in Chicago (8 Sept) and DC (14 Sept) too. Please help us spread the words on this.
