เพราะกฎหมาย 112 เกิดขึ้นมาเพื่อปิดปากประชาชน ให้วนเวียนอยู่ในปัญหาเดิม ๆ ทั้งที่ตอนนี้สังคมโลกในปัจจุบันมีปัญหามากมายที่เราต้องขบคิด แต่ประเทศไทยเรายังวนเวียนอยู่กับปัญหาการกดขี่ของระบอบอะอัตริย์ ที่ทําทุกอย่างเพื่ออํานาจของอัวเอง กฎหมาย 112 ตัวปัญหาหลักของสังคมไทยในปัจจุบัน

เพื่อจะทําให้ประชาชนสามารถมีสิทธิเสรีภาพอย่างเท่าเทียมเพื่อเป็นส่วนหนึ่งในสังคมโลก เพื่อเราจะได้ก้าวทันความเปลี่ยนแปลงของโลก เราควรต้องยกเลิกกฎหมายที่ล้าหลังนี้ ที่กดทับสังคมไทยมาอย่างยาวนาน

พิสิฏฐ์กุล ควรแถลง เกิดเมื่อวันที่ 20 มีนาคม 2529 ปัจจุบันอายุ 37 ปี ผู้มีส่วนร่วมในการก่อตั้ง FreeArts กลุ่มศิลปินที่ร่วมทํางานศิลปะในการชุมนุมในระยะเวลา 2 ปีที่ผ่านมาจนถึงปัจจุบัน เข้าไปมีส่วนร่วมจัดการในการจัดการชุมนุมและทํางานเกี่ยวกับการเมืองของไทยโดยใช้ศิลปะและดนตรีเป็นการ สื่อสาร 

ข้อกล่าวหาการละเมิดมาตรา 112: แชร์โพสต์เครือข่ายทุนเจ้าและข้อความหมิ่นพระมหากษัตริย์ ระวางโทษ 3 ปีขึ้นไป ขณะนี้อยู่ในชั้นพนักงานสอบสวน 

ความเห็นต่อมาตรา 112: เป็นกฎหมายที่ไม่มีความเป็นธรรม ขัดหลักสิทธิมนุษย์ชน การเปิดให้ใครก็ได้สามารถฟ้องร้องได้ ทําให้เกิดการกลั่นแกล้งกันทางการเมือง และรวมไปถึงการบังคับใช้กฎหมายที่ไม่มีความเป็นธรรม เจ้าหน้าที่บังคับใช้กฎหมายอย่างไม่เป็นธรรม เป็นกฎหมายที่ใช้กลั่นแกล้งประชาชนที่เห็นต่าง ทําให้ไม่เห็นความจริงที่เกิดขึ้นในสังคมไทย 

ข้อเรียกร้องจากสังคมไทยและประชาคมโลก: ขอให้ยกเลิก 112 เมื่อประเทศไทยเดินมาถึงทางตัน เมื่อเราไม่สามารถพูดความจริง ไม่สามารถถกเถียงเพื่อทําให้เกิดการแก้ปัญหาของโครงสร้างระบอบที่กดทับเราอยู่ได้ ประเทศไทยจะเดินไปข้างหน้าได้อย่างไร ถึงแม้เราจะพยายามใช้ชีวิตเพื่ออยู่รอดในแต่ละวัน เพื่อผ่านพ้นวิกฤติ ทั้งทางด้านเศรษฐกิจและวิกฤติโลก แต่เรายังอยู่ภายใต้ระบอบการเมืองที่กดขี่ ภายใต้ กฎหมายที่กดหัวเราไม่ให้สามารถพูดถึงปัญหาที่แท้จริงในสังคมไทยได้ การพยายามในการใช้ชีวิตให้อยู่รอดในแต่ละวันก็เหมือนจะไม่มีความหมาย เพราะปลายทางของปัญหายังคงเหมือนเดิม เมื่อเราไม่สามารถพูดถึงปัญหานั้นได้อย่างเต็มปาก เพราะกฎหมาย 112 เกิดขึ้นมาเพื่อปิดปากประชาชน ให้วนเวียนอยู่ในปัญหาเดิม ๆ ทั้งที่ตอนนี้สังคมโลกในปัจจุบันมีปัญหามากมายที่เราต้องขบคิด แต่ประเทศไทยเรายังวนเวียนอยู่กับปัญหาการกดขี่ของระบอบอะอัตริย์ ที่ทําทุกอย่างเพื่ออํานาจของอัวเอง กฎหมาย 112 ตัวปัญหาหลักของสังคมไทยในปัจจุบัน

Pisitakun Kuantalaeng 

112 WATCH 

Pisitakun Kuantalaeng was born on 20 March 1986. Currently he is 37 years old. He was a founding member of FreeArts which brought together artists to participate in the protests in the past 2 years. He helped organise protests and used arts and music to voice political messages. 

He has been charged with lèse-majesté for sharing contents regarding the royal wealth and that was deemed to be insulting to the monarchy. He could be charged up to 3 years. Right now, his case is under investigation. 

His view of Article 112: It is an unfair law, opposes human rights and allows anyone to file charges against others. Hence, it has become a political tool. This law also opens the way for the state authorities to treat suspects unfairly. Law has been used to undermine anyone with different ideas about the monarchy hence obscuring the truth about the royal institution. 

He demands the abolition of lèse-majesté law. Thailand has arrived at a deadlock. Thais cannot speak the truth, or seriously debate the the issue that has affected the lives of so many people. How can we move ahead into the future? Even if Thais can survive the economic downturn, but they continue to live under suppressive regimes aggravated by lèse- majesté law. With the presence of this law, there will be no future for the country. Thais are not allowed to discuss the real problem stemming from the domination of power of the monarchy. The Thai king is doing everything he can to maintain his position of power while using lèse-majesté law to achieve it.

If Thailand is able to abolish this law, it will be able to return to some kind of normalcy, being a proud member of the international community in which human rights are respected and democracy cherished.

112Watch 27 สิงหาคม  · Officially launched online now an exhibition "Faces of Victims of 112" showcasing 25 victims and their human stories. This is a part of the exhibition at LeRoy Neiman Gallery at Columbia Univ from 18-25 Sept. We will have a mobile exhibition in Chicago (8 Sept) and DC (14 Sept) too. Please help us spread the words on this.
