ไผ่เรียกร้องให้คนไทยออกมาใช้เหตุผลต่อกรณีการใช้มาตรา 112 และเราไม่ควรปล่อยให้รัฐไทยใช้ความจงรักภักดีในการลงโทษประชาชน โดยการเปลี่ยนปืนแล้วใช้กฎหมายเป็นอาวุธ และเปลี่ยนกระสุนเป็นกรงขัง

นอกจากนี้ไผ่อยากเรียกร้องให้ชุมชนระหว่างประเทศช่วยสร้างแรงกดดันต่อรัฐบาลไทยในการปลดปล่อยนักโทษการเมือง

จตุภัทร์ "ไผ่" บุญภัทรรักษา เกิดเมื่อวันที่ 1 สิงหาคม 2534 ปัจจุบันอายุ 32 ปี ไผ่ได้เข้าศึกษาที่ มหาวิทยาลัยขอนแก่น นั่นเป็นที่แรกที่เขาเริ่มกิจการทางการเมืองโดยการตั้งกลุ่มดาวดิน ที่เป็นกลุ่มที่เผยแพร่กฎหมายสิทธิมนุษยชนเพื่อสังคม เพื่อต่อสู้กับความไม่เป็นธรรมที่เกิดขึ้นในท้องถิ่น จากนั้น หลังรัฐประหารในปี 2557 ไผ่ได้มีส่วนร่วมในการตั้งกลุ่ม New Democracy Movement เพื่อขับไล่พลเอก ประยุทธ์ จันทร์โอชา ผู้ทํารัฐประหารในครั้งนั้น แต่ที่เป็นคดีดังก็คือ ไผ่ถูกกล่าวหาว่าหมิ่นพระบรมเดชานุภาพเพราะการแชร์พระราชประวัติของรัชกาลที่ 10 ที่เผยแพร่โดย BBC ไผ่เป็นเพียง 1 ใน 2 คนที่ถูกจับจากการกระทําดังกล่าว หลังจากนั้นไผ่ได้รับรางวัลกวางจูเพื่อสิทธิมนุษยชนในปี 2560 และเมื่อออกจากเรือนจําแล้ว ไผ่ได้ร่วมตั้งกลุ่มทะลุฟ้าเพื่อการต่อสู้ของประชาชนเพื่อประชาธิปไตย 

ความเห็นของไผ่ต่อการใช้มาตรา 112 ก็คือไผ่มองว่ามาตรานี้ถูกนํามาใช้เป็นเครื่องมือทางการเมือง เป็นเหมือนเพชฌฆาตประหัตประหารผู้มีความเห็นต่างทางการเมือง นอกจากนี้มันยังลดทอนความเป็นมนุษย์ เพราะผู้ที่หวังว่าจะได้รับพระราชทานอภัยโทษ จําเป็นต้องยอมรับความผิด ทั้ง ๆ ที่ตัวเองอาจจะไม่ได้ทําผิดจริง ๆ มาตรา 112 คือกฎหมายที่ล้าหลัง และสมควรถูกยกเลิกไปได้แล้ว

ความจงรักภักดีในการลงโทษประชาชน โดยการเปลี่ยนปืนแล้วใช้กฎหมายเป็นอาวุธ และเปลี่ยนกระสุนเป็นกรงขัง นอกจากนี้ไผ่อยากเรียกร้องให้ชุมชนระหว่างประเทศช่วยสร้างแรงกดดันต่อรัฐบาลไทยในการปลดปล่อยนักโทษการเมือง อยากให้ชาวโลกได้ยินเสียงคนไทยและเพื่อน ๆ ที่ยังถูกกักขังอยู่  รวมถึงร่วมเป็นส่วนหนึ่งในการผลักดันการพัฒนาประชาธิปไตยและส่งเสริมสิทธิมนุษยชน โดยการช่วยรณรงค์ให้มีการยกเลิกมาตรา 112 และสนับสนุนเสรีภาพทางความคิดและศักดิ์ศรีความเป็นมนุษย์ของประชาชนในประเทศไทย

Jatupat Boonpattararaksa 

112 WATCH 

Jatupat 'Pai' Boonpattararaksa was born on 1 August 1991. He is currently 32 years old. Based at the University of Khon Kaen, Pai helped set up "Daodin Movement" designed to promote human rights laws for the local community in fighting against injustices. He is the recipient of the prestigious Kwangju Prize for Human Rights award in 2017. Following the 2014 coup, Pai joined the New Democracy Movement as a vehicle against dictatorship. As a result, he was arrested many times. He was also arrested and imprisoned for lèse- majesté for sharing a biography of King Rama X, published on the BBC Facebook page-he became one among two who were charged amid thousand of peoples sharing the same content. Pai was released from prison in 2019. Recently, he has been behind the Talufah group calling for reform of monarchy. 

His view on the lèse-majesté law: It has been exploited as a tool to undermine political opponents. It also dehumanises them because, to be granted a royal pardon, they 

must admit their guilt of defaming the monarchy. The application of this law is normally harsh, such as not allowing bail and the legal process is not open to the public. Thus, Article 112 is anachronistic. It must be abolished to ensure political freedom. 

Pai calls for Thais to embrace reasons as they discuss Article 112. But in reality, reasons are put aside. The Thai authorities often refer to the loyalty to the monarchy when dealing with lèse-majesté charges. He calls on Thais to use legitimate means to abolish Article 112. He also makes a plea to the international community to help free those under detention in Thailand, to remove unjust laws, and to guarantee basic human rights in the country. The international community has a stake in the success of Thai democratisation because this will benefit the world as a whole.
